All users who visit or access our platform and/or use any of the services we provide agree to the terms of use and privacy policy, as well as any modifications and/or additional legal texts that may be included in the future. If you do not agree with any of the terms, you can unsubscribe from the service at any time, or if you are not a registered user, you can leave the platform.
In addition to these conditions, each of the services provided may be governed by specific terms of use and registration, and it is mandatory in all cases that the user expressly accepts them before using and/or contracting them.
ELECTRONIC CONTRACTING OF SERVICES
In accordance with the provisions of Article 23 et seq. of Law 34/2002 on Information Society Services and Electronic Commerce, contracts entered into electronically will produce all the effects provided for by law, provided that there is consent from both parties and this can be proven.
For these purposes, it will be understood that following all phases of the booking process and, where applicable, paying the corresponding amount, necessarily implies the provision of the express consent required for contracting the service.
Similarly, and in accordance with the provisions of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, all information relating to the contracting procedure is made available to users prior to the start of the contracting procedure.
The terms and conditions of service indicated below apply directly to reservations and stays made available through the website https://www.hotelelmirordorftv.com/, unless expressly stated otherwise.
RESERVATION AND CONTRACTING PROCEDURE
The booking process is carried out entirely electronically through our platform, without any physical presence of the parties and/or external physical transaction at any time.
Anyone with internet access can complete the contract as long as they are over 18 years old.
The stages of the procurement procedure are visible to users throughout the entire process. Three stages can be distinguished:
The user simply selects the accommodation and the dates they wish to book and clicks the booking confirmation button. This will begin the booking process, which will always follow the steps outlined above for all available services.
Once the establishment, number of nights, applicable taxes, total price and payment method have been selected, the platform will show the user a summary of the contract made, along with the applicable contracting conditions, which in any case must be expressly accepted by the user in order to continue the contracting process.
Once the box accepting the terms and conditions has been checked, if any of the electronic payment methods have been selected, the user will be directly redirected to the corresponding external payment platform to make the payment, without https://www.hotelelmirordorftv.com/ having any possibility of accessing the user's credit card details and/or payment systems at any time.
The security of the payment procedure is guaranteed by the financial institution.
Once the service contract is completed, a summary screen of the contract will be displayed.
If payment by credit card has been selected, it will be carried out through the bank's POS terminal, a platform completely separate and independent from the provider.
Within 24 hours, the service client will receive an email containing all the information related to the booking. This document confirms that the booking was successful and serves as proof of payment for any claims, provided it is accompanied by the corresponding payment receipt.
In the confirmation email you will find the contact details, and the rest of the instructions for arrival and departure.
The provider informs the user that all contracts made will be recorded in a file for the control and management of reservations and contracts, in which, along with the information of the contracted reservation, additional information will be reflected to guarantee the security and evidence of the correct execution of the procedure.

In the event that, for reasons beyond our control, the reservations or accommodations are not available after booking from the moment the incident is reported, the user is entitled to request the provider to terminate this contract and refund the amounts corresponding to the services not enjoyed, which will be duly refunded through the same means that the initial payment was made or, if applicable, by bank transfer.
In the event that any of the content accessible through the platform is contrary to current regulations, we undertake to proceed with its immediate removal, as soon as we become aware of it and verify the facts.
We reserve the right to cancel a reservation in cases of obvious pricing error

Passports and visas
All travelers, without exception (including children), must carry their valid personal and family documentation, whether passport or national identity card, in accordance with current legislation. Obtaining visas, passports, vaccination certificates, etc., when required for travel, is the responsibility of the travelers. Minors under 18 years of age must carry written permission signed by their parents or guardians, in case it is requested by any authority. Should a visa application be rejected by any authority due to the traveler's personal circumstances, or should entry to the country be denied due to a lack of required documentation, or because the traveler does not possess the necessary documents, the hotel declines all responsibility for such events. Any expenses incurred will be the responsibility of the traveler, and the conditions and regulations established for no-shows will apply in these circumstances.
ARRIVAL AND DEPARTURE
Check-in time 14:00 and check-out time 12:00: As a general rule and unless otherwise expressly agreed with the establishment, rooms may be used from 14:00 on the day of arrival and must be vacated by 12:00 on the day of departure.
BEHAVIOR AND RESPONSIBILITIES
INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
At https://www.hotelelmirordorftv.com/, we are deeply committed to protecting intellectual property rights. Therefore, we have established the following terms and policies:
1. RELATING TO THE ONLINE PLATFORM
The provider guarantees to the user that it is the legitimate owner of the platform and that it is not involved in any type of legal dispute prior to the signing of this contract.
The user expressly acknowledges that the provider holds all rights, titles, and interests in the platform and the software developments associated with the service, as well as in all its modules, modifications, and updates, and in any element and/or functionality developed on it, regardless of whether it has been requested by the user or not. For these purposes, this includes, without limitation, the provider's ownership of all copyright, intellectual property, and/or industrial property rights, and the right to exploit the platform without any restrictions of a temporal, territorial, or media-related nature, or with respect to methods of exploitation, and with no limitations other than those established by law.
The structure, characteristics, codes, working methods, information systems and exchange thereof, development tools, know-how, methodologies, processes, technologies or algorithms that constitute and/or may constitute the platform, are the exclusive property of the provider, being duly protected by national and international intellectual and/or industrial property laws, and may not be subject to further modification, copying, alteration, reproduction, adaptation or translation by the user, without the prior express consent of the provider.
Similarly, all user manuals, texts, graphic drawings, databases, which complement the platform and/or the materials associated with it, are the property of the provider, and may not be subject to further modification, copying, alteration, reproduction, adaptation or translation by the user.
Making the platform available as a service or simply accessing it by the user does not, under any circumstances, imply the transfer of its ownership, nor the granting of a right of use in favor of the user other than that expressed in these conditions.
In order for the user to be able to use the platform, which is the exclusive property of the provider, the provider hereby grants the user a non-exclusive license to use the platform, limited in time to each connection period, with unlimited spatial scope as it can be accessed from any computer with Internet, non-transferable, revocable and non-sublicensable.
In any case, any type of reproduction, imitation, transmission, translation, modification, creation of derivative works and/or public communication is absolutely prohibited, regardless of the means used for this purpose, otherwise the infringing user will assume all direct or indirect responsibilities that may arise.
For any aspect not expressly recognized in this contract, all rights will be reserved in favor of the provider, and written authorization from the provider will be necessary to carry it out.
2. RELATING TO USER CONTENT AND INFORMATION
All content and information published or managed by users on the platform is the exclusive property of the user, with https://www.hotelelmirordorftv.com/ being a mere information society service provider responsible for data storage.
The provider does not receive any type of intellectual property rights by virtue of the user hosting or managing them on their platform, and therefore may not in any case process them for purposes other than those directly related to the provision of the services actually contracted.
CONFIDENTIALITY AND DATA PROTECTION
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, all personal data provided during the provision of services will be processed in accordance with the Privacy Policy, which all users must expressly accept in advance in order to register.
Any user who accepts these terms of use, accepts in an informed, express and unequivocal manner our Privacy Policy, and is entitled to the rights of access, rectification, cancellation and opposition with respect to their personal data, which they may exercise as informed in the aforementioned Privacy Policy.
TEMPORARY CONDITIONS
These terms and conditions will come into effect on the date of contracting the service.
ECONOMIC CONDITIONS
The rates applicable to each of the services offered through the platform will be solely and exclusively those published on the online platform, these being the only valid ones, except for typographical or transcription errors, in which case the provider undertakes to modify them immediately.
The provider reserves the right to cancel contracts made from the moment of their execution if it detects the existence of typographical or transcription errors in the price and/or taxes applied to the transaction.
The provider reserves the right to make any changes to the rates for each accommodation, and undertakes to publish these changes on the platform in a manner visible to users. Unless otherwise stated, rate changes will not be retroactive.
The financial amounts can only be paid by direct debit or credit card, the provider never having access to any bank details or credit card information.
All rates will be increased by the amount corresponding to the taxes in force on the date of issuance of the invoice, and will be duly reflected in the summary of each purchase.

TERMINATION OF THE CONTRACT
This contract may be terminated if any of the following circumstances occur:

APPLICABLE LAW AND JURISDICTION
Any dispute or conflict arising from these terms and conditions shall be governed by Spanish law. The resolution of any legal disputes shall be subject to the jurisdiction of the courts of the user's or client's domicile.
